Terms of Service

These Terms of Service ("Terms") govern your access to and use of RecruitGem AI and all related services provided by Alovalabs ("Company", "we", "us", or "our"). By accessing, registering for, or using RecruitGem AI, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately cease using the Service.
1. Eligibility and Account Responsibility
You represent and warrant that: (a) you are at least 18 years of age, (b) you have the legal authority to enter into this agreement, and (c) you will provide accurate, complete, and current information when creating your account.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use. RecruitGem AI is not liable for any losses resulting from unauthorized account access.
2. License and Permitted Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use RecruitGem AI solely for lawful business purposes related to recruitment and talent assessment. You agree NOT to:
- Use the Service for any unlawful, fraudulent, or harmful purpose.
- Reverse-engineer, decompile, or attempt to derive the source code of the Service.
- Interfere with, disrupt, or overload the Service or its infrastructure.
- Upload malware, viruses, or any malicious code.
- Scrape, automate, or use bots to access the Service.
- Attempt to gain unauthorized access to databases or systems.
- Transmit any content that violates others' intellectual property rights.
- Harass, abuse, or discriminate against any individual.
3. User Content and Candidate Data
"User Content" means any information, documents, resumes, feedback, or other data you or candidates submit to RecruitGem AI. You retain all ownership rights to your User Content. However, by uploading User Content, you grant RecruitGem AI a worldwide, non-exclusive, royalty-free license to store, process, analyze, display, and use such content solely to provide and improve the Service.
You are responsible for ensuring you have the legal right to share candidate data with us and for compliance with data protection laws. You represent that you have obtained all necessary consents from candidates before providing their personal information to RecruitGem AI.
4. AI-Generated Content and Limitations
CRITICAL LIMITATION: RecruitGem AI uses artificial intelligence (Gemini 2.5 Flash Lite and Vertex AI) to analyze interviews and generate reports. These AI-generated outputs are provided as-is and may contain inaccuracies, incomplete assessments, or incorrect conclusions.
YOU ACKNOWLEDGE AND ACCEPT THAT:
- AI analysis is not a substitute for human judgment in hiring decisions.
- AI-generated reports are analytical tools only and should NOT be the sole basis for hiring, rejection, or employment decisions.
- You are solely responsible for independently verifying all information and conducting your own assessments before making hiring decisions.
- RecruitGem AI makes NO WARRANTY regarding the accuracy, completeness, or reliability of AI-generated content.
- We are NOT liable for any hiring decisions, employment discrimination, or adverse outcomes resulting from reliance on our reports.
5. No Guarantee of Hiring Outcomes
RecruitGem AI does NOT guarantee or make any claims about:
- The accuracy of candidate assessments or compatibility with your organization.
- Future job performance, retention, or success of any candidate.
- Prevention of bad hires or improvement of hiring quality.
- Compliance with employment law or anti-discrimination requirements.
Hiring outcomes depend on numerous factors beyond our control. You assume full responsibility for all hiring decisions and their legal and business consequences.
6. User Responsibility and Hiring Compliance
You are responsible for:
- Complying with all applicable employment laws, including anti-discrimination and fair hiring practices.
- Conducting your own due diligence and background checks as required by law.
- Making final hiring decisions using your own judgment and not relying solely on AI-generated assessments.
- Obtaining all necessary consents for candidate data processing in compliance with privacy laws.
- Using the Service in compliance with data protection regulations in your jurisdiction.
- Protecting candidate data and ensuring its secure handling throughout the hiring process.
7. Video Recording and Interview Integrity
RecruitGem AI records audio, video, and captures interview data. Video recordings are:
- Stored on Google Cloud Storage with encryption.
- Analyzed by Vertex AI for behavioral assessment and integrity detection.
- Accessible only to authorized users on your account.
- Retained as long as your account is active (deletion follows standard data retention policies).
You must obtain explicit consent from all candidates before recording interviews. Failure to do so may violate wiretapping laws and privacy regulations. You are solely responsible for obtaining such consents.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALOVALABS OR RECRUITGEM AIBE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, business opportunities, or goodwill.
- Any damage to your business reputation or hiring outcomes.
- Errors in AI-generated assessments or hiring recommendations.
- Unauthorized access to or corruption of your data.
- Third-party claims arising from your use of the Service.
Your sole and exclusive remedy against RecruitGem AI for any claim is limited to the amount you paid in fees during the 12 months preceding the claim. If you have not paid any fees, your remedy is limited to refund of your subscription fee for one month.
This limitation applies even if RecruitGem AI has been advised of the possibility of such damages.
9. Intellectual Property Rights
RecruitGem AI, including its software, design, algorithms, and original content, are owned by Alovalabsor its licensors and are protected by copyright, trademark, and other intellectual property laws. You have no right to use these materials except as explicitly granted in these Terms.
The Service is licensed, not sold, to you. You acquire no ownership rights to the Service or its underlying technology.
10. Third-Party Services and Links
RecruitGem AI integrates with third-party services including:
- Firebase (Google Cloud) — authentication and database
- Google Cloud Storage — video storage
- Vertex AI — video analysis
- Paddle — payment processing
- Sentry — error tracking
- Google Analytics — usage analytics
We are not responsible for the security, privacy practices, or availability of these third-party services. Your use of these services is governed by their respective terms and privacy policies. We assume no liability for any third-party service failures or data breaches.
11. Indemnification
You agree to indemnify, defend, and hold harmless RecruitGem AI, Alovalabs, and their officers, directors, employees, and agents from any claims, damages, losses, or liabilities arising from:
- Your violation of these Terms.
- Your use of the Service in violation of applicable laws.
- Your User Content or candidate data (including claims of privacy violation or intellectual property infringement).
- Your hiring decisions or employment practices.
- Your violation of third-party rights.
12. Termination of Service
RecruitGem AI may terminate or suspend your account immediately and without notice if:
- You violate these Terms.
- You engage in illegal or harmful activity.
- You fail to pay subscription fees.
- You repeatedly violate our Acceptable Use Policy.
Upon termination, your access to the Service is immediately revoked. We will retain your data in accordance with our Privacy Policy unless otherwise instructed.
13. Service Modifications and Availability
We reserve the right to modify, suspend, or discontinue RecruitGem AI at any time, with or without notice. We are not liable for any unavailability, data loss, or service interruptions. While we strive for high availability (99.9% uptime for core services), we make no guarantee of continuous or uninterrupted access.
14. Payment and Refunds
Subscriptions are billed monthly on a recurring basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Please refer to our Refund Policy for details on refunds and cancellations.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. All disputes arising from or related to these Terms or your use of RecruitGem AI shall be subject to the exclusive jurisdiction of the courts in India.
You irrevocably consent to the jurisdiction and venue of the courts located in India.
16. Dispute Resolution
Before pursuing legal action, you and RecruitGem AI agree to attempt good-faith resolution through informal negotiation. If negotiation fails, disputes will be subject to the courts of India. You may not pursue claims through class action or jury trial.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, or if not possible, severed. All remaining provisions shall continue in full force and effect.
18. Entire Agreement
These Terms, along with our Privacy Policy and Refund Policy, constitute the entire agreement between you and RecruitGem AIregarding your use of the Service. Any prior negotiations, understandings, or agreements are superseded by these Terms.
19. Amendments
We may update these Terms at any time. Material changes will be communicated via email or prominent notification on the Service. Your continued use of RecruitGem AI following such amendments indicates your acceptance of the revised Terms.
